FMA publishes and updates lists of investment funds and real estate investment funds eligible for investing money held in trustThe Austrian Financial Market Authority (FMA) has announced that it will publish and continuously update lists of gilt-edged investment funds and gilt-edged real estate investment funds on its website in the future.
According to the Austrian General Civil Code (ABGB), investment forms with a particularly low risk of default are considered to be eligible for investing money held in trust. The Austrian Investment Fund Act 2011 (InvFG 2011) and the Real Estate Investment Fund Act (ImmoInvFG) contain special requirements for funds that are suitable for the investment of trust funds, whereby these are based on the requirements of the Austrian Civil Code. In the case of trustee funds, the investment companies or investment companies for real estate must specify in the fund regulations, which must be approved by the FMA, in which investment instruments suitable for the investment of trust money they exclusively invest. Currently, 18 funds and two real estate funds fulfill the legal criteria. An auditor is required to verify compliance with these fund regulations in the annual report and to report irregularities or even violations to the FMA.
